Communications Regulation Act, 2002, as amended

Use of Underground Road Capacity on National Roads.
Under the Communications Regulation Act, 2002, as amended by the Communications Regulation (Premium Rate Services and Electronic Communications Infrastructure) Act, 2010, electronic communications network operators are required to obtain the consent of the National Roads Authority before carrying out roadworks involving the installation and maintenance of electronic communications infrastructure in ducts along national roads. The 2010 Act also provides, inter alia, for the application of charges by the Authority for the use of the ducts.

Locations of Ducts.
The Authority has, in recent years, adopted a practice of installing roadside ducting as part of the construction of new motorway and dual carriageway sections of the network (please see map below). While the ducting is primarily intended for current and future road-related purposes, e.g. traffic route lighting, variable message signs, I.T. applications for traffic and road network management, etc., limited spare capacity exists in some of these ducts which could cater for non-road-related uses such as electronic communications cabling.


Scheme
In accordance with section 53(11) of the Communications Regulation Act, 2002, as amended, the Authority has formulated a draft scheme which sets out our proposed policy regarding the use of underground road capacity, conditions that may be imposed in relation to the grant of consents, refusal of consent, charges and emergency roadworks. The Authority has commenced a public consultation exercise, as required under the Act, and interested parties may submit their comments / views on the policies outlined in the draft scheme as part of this process.  The closing date for receipt of submissions is Friday, 4 June, 2010.
